Wellness Rewards Points - Terms and Conditions
General Terms and Conditions
As used in these Terms and Conditions, "you," or "your" means each spa customer participating in the Wellness Rewards program. The terms "we", "our", and "us" mean Ocean Pearl Spa. For purposes of these Terms and Conditions, the phrase "net purchases" means purchases less returns. By participating in Wellness Rewards you agree to be bound by these Terms and Conditions.
We reserve the right to amend or modify the Wellness Rewards Program at any time and in any way (including, our right to discontinue benefits, expire points, and restrict point earnings-as explained more fully below, to change the benefits, or to adjust the number of points earned for each dollar in net purchases). We will give you notice if we discontinue this program or any material aspect of this program.
Wellness Rewards points may not be used/redeemed for online purchases, gift certificate purchases, retail purchases and gratuity. Value of Wellness Rewards points will be applied against total purchase price of spa services only. Wellness Rewards points are earned for net purchases inclusive of spa services, retail items and gift certificates. Points are not earned on applicable tax or gratuities. Some spa service purchases may not be eligible for earning points and this is subject to change at any time, for any reason. Ocean Pearl Spa reserves the right to cancel your participation in the Wellness Rewards Program, in the event of fraud, abuse of rewards privileges, or violation of these Terms and Conditions.
These Terms and Conditions shall be construed and interpreted under the laws of California, without regard to its conflict of law provisions.
Who is eligible?
When we approve your Ocean Pearl Spa Wellness Rewards enrollment form, you are automatically enrolled in JADE Level (Level 1) of the Wellness Rewards program and will receive rewards points for net purchases made for spa services, retail items and gift certificates. Your eligibility for PEARL Level (Level 2) will be reviewed quarterly and will be based on your eligible net purchases. PEARL Level (Level 2) requires an annual minimum of $1,000 in net purchases at Ocean Pearl Spa. Once you reach the qualifying net purchases at Ocean Pearl Spa for Level 2 your benefits include the benefits associated with the preceding level (Level 1) of the Wellness Rewards program.
You remain eligible to receive rewards points and the benefits associated with PEARL Level 2 (subject to the qualifying net purchases at Ocean Pearl Spa stated above) as long as your Ocean Pearl Spa account remains open.
How do Wellness Rewards points accrue?
You will receive 100 rewards points for every dollar in net purchases at Ocean Pearl Spa.
You will receive 1000 points for each qualified new client referral. Points are credited to your account when the transaction for the new client’s first treatment is completed. When purchasing a spa gift card for a new client, you may decide at the time of purchase to earn points for the gift card purchase or to earn new client referral points at the time of their first spa treatment visit. Points will not be earned for a new client gift card purchase in addition to points earned for referring the same new client.
You will receive 500 points when you rebook your next spa appointment at the time of check out. Rebook points will be credited to your account when the transaction for the future appointment is completed.
How are Wellness Rewards points and/or benefits redeemed?
Wellness Rewards points can be redeemed for spa treatments at Ocean Pearl Spa. Points earned may be transferred to another Wellness Rewards member at the sole discretion of that participant only with written permission.
You will receive notice that you have reached Wellness Rewards Level 2 after you have achieved the qualifying dollars in net purchases at Ocean Pearl Spa. At that time, you will also receive information about the current list of benefits associated with your Level and how to redeem those benefits. You may also receive additional information about more benefits from time to time.
Some benefits may have restrictions associated with them, may require you to purchase the benefit, may have limited available quantities, may only be available while supplies last, and/or may be subject to other restrictions. We will explain applicable restrictions to you when you receive information about the benefit.
When do Wellness Rewards points and/or benefits expire?
Reward points earned and not redeemed shall expire six (6) months from the last day of the earning period in which the points were earned, or when your account is closed. The benefits associated with Level 2 of Wellness Rewards program shall expire six (6) months after the calendar year in which you achieved the qualifying dollars in net purchases at Ocean Pearl Spa or when your account is closed.
Earning periods are defined by two (2) six month periods each year. These periods are specifically defined by Fall/Winter 2011, Spring/Summer 2012, Fall/Winter 2012, Spring/Summer 2013, Fall/Winter 2013, etc.
Points earned in Spring/Summer 2012 (January 1st-June 30th 2012) will expire December 31, 2012. Points earned in Fall/Winter 2012 (July 1st-December 31st 2012) will expire June 30th, 2013 and so on.
